Adgentek Program Policies
Effective: July 2026
These Adgentek Program Policies (the "Policies") apply to all buyers, demand partners, agencies, and advertisers (each, a "Buyer") that purchase inventory or deliver advertising through the Adgentek Services under an Adgentek Demand Partner Agreement or other written agreement with Adgentek LLC (the "Agreement"). These Policies apply across all transaction modes, including OpenRTB, direct platform-based purchasing, and agentic advertising through AdCP and other supported agentic protocols. Capitalized terms not defined here have the meanings given in the Agreement. In the event of a conflict between these Policies and the Agreement, the Agreement controls.
1. Advertising Content Standards
All ads, creatives, landing pages, and associated materials must comply with applicable laws and self-regulatory frameworks, including consumer protection and advertising laws, FTC guidance, and NAI and DAA guidelines. Required disclosures, including endorsement, testimonial, and material connection disclosures, are the Buyer's responsibility.
Ads must not:
- Be misleading, deceptive, defamatory, obscene, hateful, harassing, or unlawful
- Promote firearms or weapons, illegal drugs, unlicensed gambling, or illegal file sharing
- Contain malware, viruses, or any other malicious code
- Infringe any intellectual property right or any right of privacy or publicity
- Violate any publisher advertising policy made available to the Buyer
Regulated products and services, including alcohol, gambling, financial services, and health products, may be promoted only in full compliance with applicable law and any publisher restrictions communicated for the relevant inventory.
2. Generative AI Content
Ads that are materially generated or substantially modified by generative AI systems must comply with all applicable disclosure and synthetic media labeling requirements, and must not use the name, voice, image, or likeness of any real person without that person's verifiable consent.
3. Agentic and Conversational Placements
Where an ad is rendered within an AI application, assistant, or other agentic experience, the ad must be clearly identifiable as advertising in accordance with applicable law and the relevant publisher's disclosure conventions. Ads must not impersonate or falsely imply endorsement by the AI platform, agent, or publisher, must not appear to be organic, non-commercial output or a factual answer from the AI system, and must not deceive the end user as to the commercial nature of the content.
No ad, creative, or protocol request may contain content designed to manipulate, jailbreak, or exploit an AI platform or agent, to cause an AI system to violate its provider's safety policies, or to exfiltrate system prompts, private context, or protected data. Violations of this section result in immediate removal and may result in suspension.
4. Traffic Quality
Buyers must not generate, and must not permit any third party to generate, impressions, clicks, conversions, or installs through automated, deceptive, or manipulative means, and must not knowingly bid on or deliver ads against inventory the Buyer has identified as generating invalid traffic.
5. Data Use
Personal data and service data received through the Adgentek Services may be used only as permitted by the Agreement and the applicable Data Processing Agreement. Buyers must honor all privacy and consent signals transmitted with requests, including TCF, GPP, US privacy signals, and Global Privacy Control. Buyers must not re-identify end users, must not use data received through the Adgentek Services to build or enrich identity resolution products, data platforms, or cross-campaign user profiles, must not process sensitive personal data except in strict compliance with applicable law, must not target users under 13 for behavioral advertising, and must not use service data or Adgentek confidential information to train, fine-tune, or improve any AI or machine learning model except as expressly permitted by the Agreement.
6. Publisher Restrictions
Buyers must use commercially reasonable efforts to respect advertiser, domain, and category block lists and other publisher restrictions communicated by Adgentek, and must treat such lists as Adgentek confidential information.
7. Enforcement
Adgentek has no obligation to monitor or pre-screen ads, but may remove, block, or refuse to serve any ad, and may suspend or throttle access to the Adgentek Services, in accordance with the Agreement, where Adgentek reasonably believes these Policies have been violated or that an ad is potentially harmful to publishers, end users, or the Adgentek Services.
8. Updates
Adgentek may update these Policies from time to time by posting the updated version to this page. Adgentek will use commercially reasonable efforts to notify Buyers of material updates. Continued use of the Adgentek Services after an update constitutes acceptance of the updated Policies.
